Terms of Service - Group Training

South Park Barbell Club, LLC

These Terms of Service (“Agreement”) govern the purchase and use of recurring monthly group fitness memberships offered by South Park Barbell Club, LLC (“SPBC,” “we,” “us,” or “our”). By purchasing a membership, you (“Client” or “Member”) agree to the following terms.

1. Membership Structure & Pricing

SPBC offers recurring monthly memberships for group fitness classes. Current offerings include:

SPBC Open Group

  • 1 Classes/Week – $75/month

  • 2 Classes/Week – $125/month

Applied Strength

  • 1 Classes/Week – $75/month

  • 2 Classes/Week – $125/month

Powerlifting

  • 3 Sessions/Week – $75/month

All memberships are subject to class availability and capacity restrictions.

2. Billing & Payment Terms

  • Memberships are billed on a recurring monthly basis.

  • Billing occurs on the same calendar day each month based on the initial purchase date (e.g., purchase on May 3 → billed again on June 3).

  • There is no minimum commitment; memberships are month-to-month until canceled in accordance with this Agreement.

Late Payments

  • No fee is charged for failed payments at the time of processing.

  • If payment remains outstanding for more than 7 days, a 10% late fee will be applied to the overdue balance.

  • SPBC reserves the right to suspend access to classes until payment is brought current.

3. Cancellation Policy

  • Memberships may be canceled at any time with a minimum of 7 days’ written notice prior to the next billing date.

  • Cancellation requests must be submitted via jayne@southparkbarbell.com or through the ABC Trainerize app.

  • Verbal requests, social media messages, or informal communication will not be accepted as valid cancellation notice.

If proper notice is not provided, the next billing cycle will process as scheduled.

4. Refund Policy

All payments are non-refundable. This includes, but is not limited to:

  • Missed classes

  • Partial months of use

  • Failure to attend scheduled sessions

  • Late cancellation requests

Exceptions, if any, are made solely at the discretion of SPBC.

5. Membership Usage

  • Memberships grant access to a set number of classes or sessions per week based on the selected plan.

  • Unused classes do not roll over to future billing periods.

  • Members may reach out to jayne@southparkbarbell.com to inquire about possible make-up options; however, make-ups are not guaranteed and are handled on a case-by-case basis.

  • Class availability is subject to scheduling and capacity limits.

Memberships are structured around weekly attendance, not a bank of sessions. However, to account for variations in calendar length:

  • Members enrolled in 1 class per week will see up to five (5) sessions available in a given month.

  • Members enrolled in 2 classes per week will see up to ten (10) sessions available in a given month.

This allocation is provided solely to ensure members have access to their full weekly attendance in longer months.

Sessions do not roll over, accumulate, or convert into a class pack. Unused sessions expire at the end of each billing cycle and may not be transferred or used outside of the member’s designated weekly schedule.

Access to classes remains limited to the member’s selected membership frequency (e.g., 1x/week or 2x/week), regardless of the total number of sessions displayed in the system.

6. Holds / Account Adjustments

SPBC does not offer formal membership pauses. However:

  • Members may request account adjustments for extended absences of two (2) weeks or longer.

  • Requests must be submitted in advance to jayne@southparkbarbell.com and include the requested dates.

  • Any adjustment (such as applying a discount to offset missed time) is granted at the sole discretion of SPBC and is not guaranteed.

7. Conduct & Termination

SPBC reserves the right to suspend or terminate any membership, without refund, for:

  • Violation of gym policies or rules

  • Disruptive, unsafe, or inappropriate behavior

  • Conduct that negatively impacts staff or other members

Termination decisions are made at the sole discretion of SPBC.

8. Eligibility

  • Memberships are available to individuals 18 years of age or older.

  • By participating, you confirm that you meet this requirement.

9. Assumption of Risk & Liability Waiver

All members are required to sign a separate liability waiver prior to participation. Participation in fitness activities involves inherent risks, and members agree to assume full responsibility for their participation.

10. Changes to Terms

SPBC reserves the right to update or modify these Terms of Service at any time. Continued use of membership services constitutes acceptance of any updated terms.

Terms of Service – Gym Access Membership

South Park Barbell Club, LLC

These Terms of Service (“Agreement”) govern independent gym access memberships offered by South Park Barbell Club, LLC (“SPBC,” “we,” “us,” or “our”). By purchasing a gym access membership, you (“Member”) agree to the following terms.

1. Membership Overview

Gym Access Membership allows members to use the facility independently during designated hours. This membership does not include coaching, instruction, or access to structured group classes unless otherwise specified.

2. Access Hours

Members may access the facility during the following hours:

  • Monday through Friday: 5:00 AM – 10:00 PM (entry permitted until 10:00 PM)

Members may enter the facility starting at 5:00 AM and up until 10:00 PM. After 10:00 PM, entry is no longer permitted. Members already inside may finish their session and exit, but may not re-enter.

All members must fully exit the facility within a reasonable timeframe after completing their workout.

3. Billing & Payment Terms

  • Memberships are billed on a recurring monthly basis.

  • Billing occurs on the same calendar day each month based on the initial purchase date.

  • Memberships are month-to-month with no minimum commitment unless otherwise stated.

Late Payments

  • Payments not completed within 7 days of the billing date may incur a 10% late fee.

  • Access may be suspended until payment is brought current.

4. Cancellation Policy

  • Memberships may be canceled with a minimum of 7 days’ written notice prior to the next billing date.

  • Cancellation requests must be submitted via EMAIL or through the ABC Trainerize app.

  • Verbal requests, social media messages, or informal communication will not be accepted.

Failure to provide proper notice will result in the next billing cycle processing as scheduled.

5. Refund Policy

All payments are non-refundable, including unused time or partial months.

6. Member Responsibilities

Members agree to:

  • Use equipment safely and as intended

  • Return all equipment to its proper place after use

  • Maintain cleanliness and respect shared space

  • Not wear outside shoes in the gym

  • Follow all posted gym rules and staff instructions

  • Secure the facility upon entry and exit

Members are responsible for their own workouts and safety while training independently.

7. Prohibited Conduct

The following are strictly prohibited:

  • Allowing non-members or guests into the facility

  • Sharing access credentials or keypad codes

  • Allowing others to enter without using their own code (“tailgating”)

  • Coaching or training other individuals for compensation

  • Behavior that is unsafe, disruptive, or disrespectful

  • Use of illegal substances or alcohol on premises

8. Liability & Assumption of Risk

Members must have a signed liability waiver on file prior to using the facility. By training independently, members acknowledge the inherent risks of unsupervised exercise and assume full responsibility for their participation.

9. Security & Access Control

  • Access is controlled via individual keypad entry codes issued to each member.

  • Members must keep their code confidential and may not share it under any circumstances.

  • Each individual must use their own code to enter. No exceptions.

  • Members are responsible for ensuring the door is securely closed and locked after both entry and exit.

Failure to follow access procedures may result in suspension or termination of membership.

10. Safety Requirements

  • Members may not attempt maximum or near-maximum lifts while training alone unless appropriate safety measures (e.g., safeties or spotters) are in place.

  • Members training alone are required to wear the Greenlight safety tracker at all times while in the facility to ensure emergency access if needed.

  • Members are responsible for exercising within their limits and using equipment safely.

11. Facility Rules

Members agree to the following:

  • Audio Use: Members may connect to the gym sound system; volume must not exceed level 2.

  • Chalk: Only liquid chalk is permitted.

  • Cleanliness: Equipment must be returned to its proper place and the space left in good condition.

12. Surveillance

  • The facility is monitored by video surveillance inside and outside the premises.

  • By entering the facility, members acknowledge and consent to being recorded for safety and security purposes.

13. Termination

SPBC reserves the right to suspend or terminate membership, without refund, for:

  • Violation of these Terms

  • Misuse of facility or equipment

  • Unauthorized access or code sharing

  • Failure to follow safety requirements

  • Behavior that jeopardizes safety or community standards

14. Eligibility

  • Members must be 18 years of age or older.

15. Changes to Terms

SPBC reserves the right to update or modify these Terms at any time. Continued use of the facility constitutes acceptance of any updates.
